Throughout these Terms & Conditions, “Patrick Michael Creative,” “we,” “us” and “our” refer to La Flamme Rouge Photography, Inc. doing business as Patrick Michael Creative.

By accessing this website or placing an order, you agree to these Terms & Conditions.

Patrick Michael Creative offers photographic artwork in a variety of print formats, sizes, frames and finishes. Most artwork is produced to order based on the options selected at the time of purchase.

We make every reasonable effort to accurately display our artwork and product options. However, colors and appearance may vary somewhat between your screen and the finished physical artwork due to differences in displays, materials, printing processes, lighting and other factors.

Product photographs, room displays and interior mockups may be used to help demonstrate the appearance and presentation of artwork. These images are illustrative and may not represent exact scale, color or appearance in every environment.

Prices are displayed in U.S. dollars unless otherwise stated. Prices may vary according to artwork, size, print type, framing and other selected options.

Patrick Michael Creative reserves the right to change prices or product availability at any time. Changes will not affect orders that have already been accepted.

Applicable sales tax will be calculated during checkout when required.

Submitting an order through the website constitutes an offer to purchase the selected products. An order is considered accepted after payment has been successfully processed and the order has been confirmed.

We reserve the right to cancel or decline an order in circumstances such as pricing or product errors, suspected fraud, inability to produce the selected configuration, or other circumstances that prevent us from reasonably fulfilling the order.

If we cancel an order after payment has been collected, the amount paid for the cancelled portion of the order will be refunded.

Payments are processed securely through Stripe. Available payment methods may vary and will be displayed during checkout.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the amount shown at checkout to be charged.

Most artwork sold by Patrick Michael Creative is made specifically for your order. Production and fulfillment may be performed by professional print and fulfillment partners, including LumaPrints.

Production times are estimates and may vary depending on the product, size, framing options, order volume and other circumstances outside our direct control.

Shipping availability, estimated production and delivery times, damaged shipments and related policies are described on our Shipping & Returns page, which is incorporated into these Terms & Conditions.

Customers are responsible for providing a complete and accurate shipping address. Please review your shipping information carefully before submitting an order.

Delivery dates are estimates and are not guaranteed. Patrick Michael Creative is not responsible for reasonable delays caused by carriers, weather, natural disasters or other circumstances outside our control.

Because our artwork is produced to order according to the size, material, frame and other options selected by the customer, we generally do not accept returns or exchanges for preference changes, incorrect size selection or other buyer-choice reasons after production has begun.

If your artwork arrives damaged, defective or materially different from what you ordered, please contact us promptly. We will work with you to evaluate the issue and, when appropriate, arrange a replacement or other resolution in accordance with our Shipping & Returns policy.

Please review the Shipping & Returns page before purchasing for complete information regarding cancellations, damaged orders, replacements and returns.

Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable law.

Oversized artwork, custom dimensions, commercial installations and other special orders may require separate pricing, production, shipping or delivery arrangements.

Additional terms may apply to custom or commercial projects. When applicable, those terms will be provided before the order is finalized.

All photographs, artwork, images, designs, text, logos and other original content displayed on Patrick Michael Creative are protected by applicable copyright, trademark and other intellectual property laws.

Purchasing a physical print does not transfer copyright or other intellectual property rights in the underlying photograph or artwork.

Artwork purchased from Patrick Michael Creative is intended for display and enjoyment. You may not reproduce, scan, copy, distribute, publish, license, sell or otherwise commercially exploit the artwork or images without prior written permission.

You agree not to use this website for unlawful purposes, interfere with its operation, attempt to gain unauthorized access to the website or its systems, or use automated methods to improperly copy, scrape or extract website content.

We may modify, suspend or discontinue portions of the website at any time without notice.

Our website may use or link to services operated by third parties, including payment processors, fulfillment providers, shipping carriers and other technology providers.

Those services may be subject to their own terms and privacy policies. Patrick Michael Creative is not responsible for the independent operation of third-party websites or services.

We make reasonable efforts to ensure that product descriptions, pricing and other information on this website are accurate. However, occasional errors or omissions may occur.

To the fullest extent permitted by applicable law, La Flamme Rouge Photography, Inc. and Patrick Michael Creative will not be liable for indirect, incidental, special or consequential damages arising from the use of this website or the purchase or use of our products.

To the fullest extent permitted by applicable law, our total liability arising from a particular purchase will not exceed the amount actually paid to Patrick Michael Creative for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
